Truck Driver in Tracy Morgan Crash Charged With Death by Auto

Nearby in New Jersey, a tragic accident is still wreaking havoc on the families of several comedians, including the family of James McNair, who was the only fatality in the accident. Actor and comedian Tracy Morgan was critically injured in the accident and still remains in the hospital. He was previously in critical condition but has now become more stable, though he will likely stay hospitalized for several more weeks.

So what was the cause? Reports are now saying that the truck driver's lack of sleep led to his poor reaction time in the several car pileup. The criminal complaint states that the Walmart truck driver was operating his vehicle without having slept for over 24 hours.

The National Transportation Safety Board and police are looking into any other factors that may have led to the crash, including drug or alcohol use. The driver has been charged with one count of death by auto, or vehicular manslaughter, and four counts of assault by auto, which New Jersey law permits in such instances.

Charged with vehicular manslaughter or DUI?

Any type of criminal charge that occurs while an individual is driving can result in severe consequences. Due to the fact that many people are often on the road, those involved in vehicle crimes, such as DUI, hit-and-run, or vehicular manslaughter will face serious penalties.

Vehicular manslaughter can carry up to 15 years in prison and be charged as a felony offense. If alcohol or illegal substances were involved, the charges may be escalated.
